These Terms & Conditions ("Terms") govern your use of the website https://www.placitaescondida.com (the "Site") and any related services provided by ACP Placita Escondida Properties, LLC ("we," "us," or "our"), including SMS text message communications. By using our Site or services, you agree to these Terms. If you do not agree, please do not use our Site or services.

ACP Placita Escondida Properties, LLC is an Arizona limited liability company operating Placita Escondida Condominiums, a new construction real estate development in Tucson, Arizona. We provide information about, and sell, newly built condominium residences.

2. Eligibility

You must be at least 18 years old and able to enter into a binding contract to use our Site, contact us, or receive SMS messages from us.

3. Use of the Site

You agree to use our Site only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use of the Site by, any third party. You agree to provide accurate information when submitting any contact form or inquiry.

4. SMS Text Messaging Terms

If you provide your mobile number and consent to receive text messages from us — by checking the SMS consent box on our contact form, or by texting our published business number first — the following terms apply to that communication:

  • Purpose: SMS messages are used to respond to your inquiry and provide customer service related to our properties and services. We do not send marketing or promotional text messages.

  • Frequency: Message frequency varies based on your conversation with us.

  • Rates: Message and data rates may apply, based on your wireless carrier plan.

  • Opt-out: You may opt out at any time by replying STOP. After we receive your STOP message, we will send one final confirmation message and will not send further texts to your number.

  • Help: Reply HELP at any time for assistance, or contact us using the information in Section 11.

  • Privacy: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for full details on how we collect and use your information.

  • Carrier disclaimer: Wireless carriers are not liable for delayed or undelivered messages.

5. Property and Pricing Information

All floor plans, elevations, features, pricing, plans, amenities, specifications, and related information, as well as information concerning the pricing and availability of our homes, are subject to change without notice. Move-in dates are not guaranteed. All sales are subject to the terms and conditions set forth in the Purchase Agreement signed between you and us. Registration on our Site does not guarantee a contract.

6. Financing Information

Any interest rate, annual percentage rate (APR), or financing information provided through our Site or SMS messages is for general market awareness and illustrative purposes only, and is not a commitment to lend. All loans are subject to credit approval, may include additional closing costs, and are subject to lender terms and conditions. Promotional financing rates may require the use of a preferred lender and are subject to change or discontinuation at any time without notice. You are encouraged to consult directly with a qualified lender for full terms and disclosures.

We do not warrant that the Site or our communications will be uninterrupted, error-free, or free of viruses or other harmful components.

To the fullest extent permitted by law, ACP Placita Escondida Properties, LLC and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Site, our SMS communications, or your reliance on any information provided through them.

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or your use of our Site or services will be resolved exclusively in the state or federal courts located in Pima County, Arizona, and you consent to the jurisdiction of those courts.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Your continued use of our Site or services after changes are posted constitutes your acceptance of the revised Terms.
